These terms govern your use of this website and the Smash Robotics customer portal. Delivery of a station is governed by a separate services agreement.

1. Agreement

These terms are between you and Smash Robotics ("we", "us"). By using this website or signing in to the customer portal, you accept them. If you do not accept them, do not use the site or the portal. Questions: legal@smashrobotics.com.

2. Scope, and what these terms are not

These terms cover the website and the portal only. Assessment, hardware sourcing, installation, training, and ongoing management of a station are governed by a separate written services agreement with your organisation. Where that agreement conflicts with these terms, the services agreement takes precedence for those services.

3. Website content is not an offer

Descriptions of our approach, phases, timelines, and pricing structure are informational. They do not constitute an offer, a quotation, or a warranty of any particular result. Figures and scope are confirmed only in a written proposal after we have seen the task on site.

4. Accounts and access

Portal access is by invitation only. You must be authorised by your organisation to hold an account, provide accurate details, keep your credentials confidential, and tell us promptly if you suspect unauthorised access. Accounts are personal — do not share them. We may suspend or remove access where these terms are breached, where an account is no longer authorised by the customer, or where necessary to protect the service.

5. Acceptable use

You must not:

  • access data belonging to another organisation, or attempt to;
  • probe, scan, or test the security of the site or portal without written consent;
  • scrape, resell, or systematically extract content or data;
  • upload malware, or content you have no right to upload;
  • interfere with service availability, or use it unlawfully.

6. Ownership of your data and models

You keep ownership of the operational data from your site and of the models trained on it. You grant us only the limited licence needed to host, process, and support the station and the portal, as set out in the services agreement and its data processing terms. Your data and models are exportable, and ending our relationship does not stop your station from running.

7. Our intellectual property

The site, the portal software, our documentation, methods, and the Smash Robotics name and marks are ours or our licensors'. You may view and print website content for your own internal evaluation. No other licence is granted, and nothing in these terms transfers our intellectual property to you.

8. Confidentiality

Information exchanged through the portal or in enquiries and clearly commercially sensitive — task timings, throughput figures, site layouts, pricing — is treated as confidential by both sides and used only for evaluating or delivering the work, unless a separate NDA says otherwise.

9. Availability

We aim to keep the site and portal available but provide them "as is" and "as available". We may change, suspend, or withdraw features, and we carry out maintenance that can cause downtime. Service levels, where they apply, are set out in the services agreement, not here.

10. No reliance for safety decisions

Nothing on this website or in the portal replaces your own risk assessments, machinery safety obligations, or regulatory duties for equipment on your site. You remain responsible for compliance at your premises, supported by the safety scope agreed in the services agreement.

11. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, we are not liable for loss of profit, loss of production, loss of data, or indirect or consequential loss arising from use of this website or the portal, and our total liability under these terms is limited to GBP 1,000. Liability for delivered services is dealt with in the services agreement.

12. Third-party links

We are not responsible for the content or practices of third-party sites we link to.

13. Changes to these terms

We may update these terms. The date above shows the current version, and continued use after a change means you accept it. We notify portal users directly of material changes.

14. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them.
